1. GENERAL TERMS AND CONDITIONS OF SALE
These General Terms and Conditions of Sale (“General Conditions”) govern the offer and retail sale of wines and spirits (hereinafter “Products”) and apply to all orders placed by users (hereinafter “Customer”) through the website vogliadivino.com (hereinafter “Website”), owned by Voglia Di Vino di Bernardoni A. & Scutaro R. S.n.c. (hereinafter “Voglia Di Vino”), headquartered in (56028) San Miniato (PI), Fraz. Ponte a Egola, Via XXV Aprile No. 18, VAT and Tax Code: 01835690502.
The General Conditions applicable to each order shall be those displayed on the Website at the time the order is placed. Voglia di Vino reserves the right to modify these General Conditions at any time; any changes will become effective upon publication on the Website and will apply only to orders placed thereafter. Customers are therefore invited to review these General Conditions before making any purchase on the Website, and to print and/or save them on any durable medium of their choice.
2. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE
All purchases of Products made through the Website by Customers who access it are governed by these General Conditions, as well as by the Italian Consumer Code (Legislative Decree No. 206/2005), Section II on Distance Contracts (Articles 50–67), and Italian regulations on e-commerce (Legislative Decree 70/2003).
By placing an order on the Website, the Customer declares to have read, understood, and fully accepted these General Terms and Conditions of Sale.
3. PUBLIC OFFER AND AGE LIMITATION
The Products and prices displayed on the Website constitute a public offer exclusively for adults, subject to the limitations and procedures set out on the Website and in these General Conditions.
Purchases on the Website are reserved exclusively for individuals who are at least 18 years old. For purchases made by citizens of countries other than Italy, the Customer may purchase only if they are of legal drinking age according to their national laws; if no legislation exists, the minimum age is 21.
The Customer must therefore declare, under their own responsibility, that they are at least 18 years old and that they comply with the alcohol purchase and consumption laws of their country.
Voglia di Vino declines any liability for purchases made in violation of these rules.
4. REGISTRATION AND ACCOUNT
To make purchases, the Customer may create a personal account or proceed as a guest. In both cases, the Customer must provide accurate and up-to-date information.
The Customer is responsible for safeguarding their login credentials and for any activity carried out through their account.
5. PRODUCTS
Voglia di Vino reserves the right to modify at any time the selection of Products offered on the Website, as well as their prices and/or characteristics.
In any case, Voglia di Vino will not change the price or description of any Product after sending the Order Confirmation to the Customer.
Each Product is accompanied by an information page describing its main features (“Product Sheet”). The images shown on the Website are for illustrative purposes only and may not correspond to the actual packaging of the delivered Products, particularly if the manufacturer has updated the packaging. Product photos are therefore indicative and may differ from the catalogue presentation.
6. PRICES AND PROMOTIONS
The prices displayed on the Website for all Products (including the price per unit of measure expressed in €/L) include VAT and packaging costs, unless otherwise indicated.
Product prices and any promotions are applied at the time the Order is submitted or modified and subsequently confirmed by Voglia di Vino. Therefore, Voglia di Vino cannot guarantee that the price of an item placed in the shopping cart will remain unchanged until the Order is actually submitted (some promotions are time-limited and may expire beforehand).
7. SHIPPING AND DELIVERY
The Seller ships Products to Italy, the European Union, and non-EU countries listed on the Website.
Prices do not include any taxes, duties, and import fees applicable in the country of destination when outside Italy. These costs, which vary by country, are the responsibility of the Customer, who must verify the amounts with the relevant customs authorities.
Any delays caused by customs or local inspections are not attributable to the Seller.
Shipping costs are not included and will be calculated before the Order Confirmation is sent by Voglia di Vino.
8. ORDER ACCEPTANCE
The Customer may use the service (“Service”) by placing an order directly through the Website. The Order will be binding for Voglia di Vino only if the entire procedure has been completed correctly, without error messages from the Website.
9. ORDER CONFIRMATION, CANCELLATION, AND MODIFICATION
The Customer will receive an Order Confirmation at the email address provided during the purchase process. The confirmation will include a summary of the Products, their prices, shipping costs, delivery date, and any applicable terms for order modification or cancellation, as well as the applicable General Conditions.
The Customer must complete payment within 24 hours. After this deadline, the Order is automatically cancelled and the Products become available again. Voglia di Vino reserves the right to sell them to other customers.
10. UNAVAILABLE WINES/SPIRITS AND PURCHASE LIMITATIONS
Voglia di Vino shall not be liable for the temporary or permanent unavailability of one or more Products. In case of unavailability, even temporary, Voglia di Vino commits not to charge the Customer for the corresponding amount.
11. RIGHT OF WITHDRAWAL
Customer rights are protected under Legislative Decree 206/2005.
EU-resident consumer Customers have the right to withdraw from the contract without explanation and without incurring costs, provided that the withdrawal is communicated via registered mail with return receipt to Voglia Di Vino Di Bernardoni A. & Scutaro R. S.n.c., Via XXV Aprile 18, 56028 San Miniato (PI), Fraz. Ponte a Egola, or via email to info@vogliadivino.com within 14 (fourteen) days from receipt of the Products, indicating the order number and date, the Product subject to withdrawal, and the bank details for the refund.
The Customer must return the Product at their own expense within 14 (fourteen) days from receipt, to the above address.
The essential condition for exercising the right of withdrawal and receiving a refund is the substantial integrity of the returned Product.
The Product must be returned in its original packaging, intact, sealed, unopened, unused, and suitable for resale without the next buyer being able to assume it had a previous owner.
The Customer is responsible for any damage, theft, or loss of the Product during return shipping.
If the withdrawal is exercised correctly, Voglia di Vino will refund the purchase price, including standard delivery costs (excluding any additional costs for non-standard delivery methods), within 14 (fourteen) days from receipt of the returned Product. The Customer is liable for any decrease in value resulting from handling beyond what is necessary to verify the nature and functioning of the Product.
12. COMPLAINTS
Unless the Customer exercises the right of withdrawal as per Article 11, Products are considered accepted upon delivery.
If a Product arrives visibly damaged (e.g., broken packaging or stains from leaked wine), the Customer must refuse the shipment. Voglia di Vino will arrange for return and replacement.
For errors not immediately detectable upon delivery, the Customer may request a replacement or refund within 8 (eight) days of receipt. Voglia di Vino will contact the Customer at the email provided at checkout with instructions for returning the Product.
The Product must always be returned in its original packaging and condition.
If the Product is out of stock, the Customer will be contacted to choose between replacement with an alternative Product or a full refund.
